What is MCA debt consolidation?
MCA consolidation replaces several merchant cash advance payments, often daily or weekly ACH debits to different funders, with one restructured payment. It usually happens in one of two ways: a restructuring firm negotiates lower payments and longer terms with each funder, or a new lender pays off the existing advances and you repay that one lender. Both aim to reduce how much leaves your bank account each day.
What happens if I default on a merchant cash advance?
Most MCA contracts let the funder demand the full remaining balance, add default fees, enforce the owner's personal guaranty, send UCC lien notices to your customers or payment processors, and sue, often in New York. Since 2019, New York no longer lets funders file confessions of judgment against businesses located outside New York.
Can MCA debt be settled for less than I owe?
Often, yes. Funders frequently accept a reduced payoff or lower payments rather than risk a full default. Advertised results vary: Business Debt Adjusters says it typically settles at 50–65% of the original balance, and Delancey Street advertises a 50% average payment reduction. These are the companies' own claims, so ask whether any figure is quoted before or after fees.
How much do MCA relief companies charge?
Among the companies we reviewed, published fees ran 15–25% of enrolled debt (Business Debt Adjusters; National Debt Relief for other kinds of business debt). Most companies don't publish their fees. Eastern Financial Partners builds its fee into the reduced payment. Get the fee, cancellation terms and refund policy in writing before you sign.
Is a merchant cash advance a loan?
An MCA is usually structured as a purchase of future receivables, not a loan, so state interest-rate caps typically don't apply. A court may treat it as a loan if repayment isn't truly tied to sales, for example when there's no working reconciliation clause, the term is fixed, or the funder has full recourse if the business fails. If a court finds it's a loan, usury laws can apply.
Do I need an attorney for MCA debt?
If a funder sues you, you need an attorney; settlement companies that aren't law firms can't represent you in court. Of the 11 companies we ranked, Eastern Financial Partners and Corporate Rescue Advisors say an attorney from Rimon Law is assigned to every case from day one; 3 others work with attorney networks or provide legal resources on some cases; the other 6 don't mention attorney representation.
How do I check whether an MCA relief company is legitimate?
Look up its BBB profile and complaint history, read recent Trustpilot and Google reviews, confirm that the business name, address and phone number on the contract match those profiles, and get a written fee agreement with cancellation and refund terms. Be cautious of anyone who tells you to stop paying funders without explaining what will happen to your bank account.
What protections do Florida businesses have against MCA funders?
Florida's criminal usury law (Fla. Stat. § 687.071) makes interest above 25% a year a misdemeanor and above 45% a felony, but it applies only if a court decides the MCA is really a loan. Some Florida businesses have used usury and FDUTPA claims as leverage in settlement talks. A Florida-licensed attorney can tell you whether your contract qualifies.
